Let's not lose sight of the fact that Sgt. Peralta WAS a citizen at the time of his death. Just not the type of citizen of which Brooke approves.

Trog: A state court judge cannot order somebody held for deportation after their sentence is complete, especially if there is no deportation order (from a court of competent jurisdiction) in place. Thus the need for communication between the state and the feds.

Folks: Let's not forget that it doesn't matter what the peanut gallery (and I include myself in that category) on this board says. Rather, a federal court has issued a ruling and the US Attorney(s) for that district (or districts, as I don't recall if it was a district court or circuit court ruling)...

If you think that following the Constitution is "playing legal word games," then you are correct.
The next time somebody you think is guilty gets a fair trial, I guess that is playing legal word games as well.

The Fourth Amendment to the US Constitution says that people cannot be detained beyond the time of their sentence. One other thing: we need to find a way to capture the rain run off freely flowing down the LA River and into the ocean.
