Given the district court judge's reversal of the magistrate judge's ruling, I guess we will see what the circuit court (the appellate level) thinks of all of this.
Your "should be possible" gives me no comfort. I do not trust the government to act responsibly.

With all the talent the government has, it can figure out how to do this. Compelling a 3rd party to do it isn't the solution. I see that the district judge reversed the magistrate judge's ruling. Your iPhone is not off-limits if a warrant is obtained. If it is locked, it is up law enforcement to unlock it. You cannot be compelled to do so under the 5th Amendment. If you are referring to the Apple/FBI spat, it is a completely different issue which was discussed in another thread just recently.

What if the family doesn't want him there? If that sufficient "honest justification?"
I don't know (or particularly care) if that is true, but given the lack of affinity between the president and Justice Scalia, it wouldn't surprise me.
