New California law AB5

New law passed (AB5) in Sacramento about independent contractors could kill sports officials in the state. I'm a soccer referee and work as an independent contractor and gets games from Orange County Referee Association. https://www.ocsra.org.

I just don't see how this is going to play out as all club soccer coaches are also independent contractors. This law starts Jan. 1 2020. #-o

Maybe Zebra has some information on what going to happen in local high school sports.

I'm wondering if the law can be sidestepped in those cases by calling it hobby income and/or paying them less often than 25 times in a year or maybe splitting the games up into "packages". Writers and photographers are different and their claims are much more significant, since that's how they make their livings. Well-meaning but dumb law.

It's a fire hose turned on the companies that abuse IC's and it's sweeping up all the industries that use them legitimately. And it's putting all those legitimate IC's out of work. The goal is good - and it's overdue - but the method is awful.

This law is a monster.

The law firm I work for is giving seminars to all the businesses freaking out over it. The law is going to be instantly litigated so will probably be put on hold for some time as the many, many court cases are processed.

I hope more people leave. The traffic here is only getting worse.

Ask your friend if any of his new neighbors have been affected by any of these laws personally or if they're just more Kool-Aid-swilling Hannity fans wanting to live among their own kind. Rational or not, "red flight" has definitely become a thing.

I wouldn't be surprised if AB5 is put on hold first thing Thursday morning and is struck down fairly quickly after that. Contract labor abuse has been a problem for years but this law is a horrible way of trying to address it.

I am actually one who bailed out-after my kid finished HS in south OC last June. Biggest reason was cost of living (housing is half in AZ as it is in CA)-political climate is a plus, although since the primary reason to move is economic, AZ's politics are shifting (although not as much as D's would like).

I would say my neighbors in newer 55+ community are mostly R, but not all. Lots of govt employee retirees here. Area is mostly R (lots of cops/ex cops and current/retired military). Real cowboy bars not far away from neighborhoods that feel like Ladera Ranch-and not far away from real trailer-park rural poverty. Definitely 2A friendly in AZ (it's why I don't think that Mark Kelly will win-this state isn't ready for a gun-control guy).

Another factor in moving is retirement income-in CA 401K/Keough distributions are taxed at 11%, while in AZ it's 4%. AZ doesn't tax social security income either.

There's a chance this would have impacted me (not sure but possible). It's had a big impact on freelance editorial/photography and independent truckers also-not the industry they were looking to curb.

Do think that many in places like south OC are either planning to leave when the time is right or are thinking of it. I do know people in south OC and similar places (Thousand Oaks, Valencia) who have mentioned that they constantly get direct mail pieces from realtors in places like AZ, ID and NV.

Agree it will get killed off in the courts. First rule of politics is "do no harm"-this harms many more people than it helps, much like Obamacare has done.

I also suspect that incorporating might be a legit workaround for many freelancers/independent contractors.

Hey JQP - I guess you're not a right leaning individual, just a guess. Maybe, just maybe, people are leaving the state because they are sick and tired of being OVER taxed. If you're not being taxed on your income, (I pay more taxes with CA than the Fed) then you're paying excessive sales tax and then you're paying property tax, where in some cases paying an additional assessment or Mello Roos on top of your property tax. Then our wonderful citizens vote to pay MORE taxes on our gasoline so those funds can be used for road/highway improvements but the funds get diverted to some other project or the general fund so the pensions can be paid, yes our imploding public employee pension system, aka a Ponzi scheme. Bet you love "Red Flight" then you can hang out with all your champagne socialists. :rockon:

I know I do.
